Appraisals for Legal Disputes

The accurate valuation of a business or professional practice is an important aspect in many disputes. Many of these require a well-supported, impartial, professional appraisal that is defensible in court. In many partnership or marital dissolutions, we suggest a joint appraisal. This means that one appraiser is engaged by both parties to provide the appraisal report. This method can save the clients both time and money.

Safe Harbors in Leasing

Healthcare is a highly regulated industry, in which there are often referral relationships between parties that need financial separation. Under Stark legislation, physicians cannot refer patients to services wholly or partially owned by them. A Safe Harbor is a legally permissible relationship that separates the financial interests of the parties involved in a referral situation. One such relationship is a lease, in which the owner entity (physician or provider) sells the equipment in question to an outside party who then leases the equipment back to the physician at a Fair Market Value lease rate. This lessor has no referring connection to the physician and is not influenced by, nor is it able to influence, the referral process. We can perform an asset appraisal at Fair Market Value for the transfer of the asset(s) and assign a Fair Market Value lease rate for such a lease.
